A Federal High Court sitting in Lagos, varied the bail conditions of Managing Director and Chief Executive Officer of Fin Bank Plc, Mr. Okey Nwosu and a former director of the bank, Dayo Famoroti, to allow them travel abroad.
Nwosu and Famoroti, who are standing trial before the court on charges of corruption leveled against them by the Economic and Financial crimes Commission, EFCC, were last year, restricted by the court from traveling out side the country.
Trial judge in the matter, Justice Dab Abutu in his ruling on applications by the duo for the variation of their bail conditions to allow them travel out of the country, ordered the release of Famoroti International Passport, to enable him travel for medical treatment and business to United States of America.
The court also varied the third leg of the bail condition, which prohibited the accused persons from traveling outside the shore of the country, during the pendency of the charge. The varied part read, “the accused persons are prohibited from traveling outside Nigeria without the leave of court during the pendency of the charge.â€
According to the court, Famoroti’s International Passport already with the Court Registrar should be released to him for his trip to USA.
The court added that he should return the passport on or before September 20, 2010
Justice Abutu in his ruling, said that the applicants had exhibited their good conducts by regular attendance to court since they were granted bail last year, while the matter was adjourned till October 18, 19 and 20 for definite trial.
Nwosu’s had in his application, prayed the court to vary the terms of his bail given on September 15, 2010, arguing that the limitation in the bail condition granted to him by the court amounts to giving him bail on one hand and taking it with another by putting him in the prison of Nigeria.
