ONITSHA—The Court of Appeal sitting in Enugu, presided by Justice Amiru Sanusi, will today rule on the motion filed by the ousted member of Ihiala federal constituency, of Anambra State, Chukwumeze Nzeribe against Mr Vitalis Okafor demanding that the court judgement that sacked him(Nzeribe) on 9 July 2009, should be set aside and a new panel of three justices set up to hear the motion afresh.
The Appeal Court had last year in its verdict, nullified the election of Mr Chukwumaeze Nzeribe on the grounds that he was not the duly nominated candidate of Anambra State’s Peoples Democratic Party, PDP, for the 2007 House of Representatives election,
Not satisfied with the judgement, Nzeribe returned to the Appeal Court to contest the verdict in a motion on Notice he filed through his counsel Osiagu Ugochukwu, on 17 July 2009, demanding that the judgement be set aside and that Justice Olukoya Ariwoola who was one of the justices should be disqualified from participating in the hearing of the motion.
