Appeal court voids lawmaker’s election

THE Appeal Court sitting in Ibadan yesterday nullified the election of a lawmaker in the Oyo State House of Assembly, Mr. Dauda Lawal. The lawmaker who contested on the platform of the Peoples Democratic Party in the 2007 election represented Lagelu State Constituency.

His victory was challenged by the candidate of the All Nigeria Peoples Party(ANPP), Mr. Sikiru Adebayo on the grounds that it was fraught with electoral malpratices, over voting which violate the Electoral Act 2006.

Based on the allegation that the election that ushered him into the legislative arm was not properly conducted, the lawyer to the ANPP candidate, Mr Abdul-Wahab Adesina, urged the court to confirm the earlier verdict of the lower tribunal.

At the sitting of the court yesterday, Justice Istifanus Thomas who led other justices cancelled his election and ordered a fresh election to be conducted within 90 days. While upholding the judgment of the lower tribunal, the court said, “We hereby uphold the nullification of the election by the lower tribunal on the grounds of corruption, malpractices, over-voting and non-compliance with Electoral Act”.

Reacting to the judgment, the ANPP secretary in the state, Mr. Sola Osotoye, “Judiciary indeed is the last hope of the common man. We are sure of victory in the fresh election to be conducted”.
