As Nigeria joins other continents in celebration of the United Nations’ Human Rights Day, many observers have described 2014 as a horrific year for human rights violations in the country, saying terrorism is the major source of abuses around the NorthEast and the world.

As Nigeria join the rest of the world to celebrate this year’s Human Rights Day, Legal Defence and Assistance Project, LEDAP, and International Society for Civil Liberties & the Rule of Law, Intersociety, have tasked the Nigerian Government, to ensure that it and its agencies, respect the rights of Nigerians.

The law firm of former Nigerian Bar Association, NBA, President, Dr Olisa Agbakoba, SAN, has re-launched its Police Dialogue Series, which it noted was in keeping with new trends and best practices in the world legal practice.

In this piece, I have endeavoured to chart the legal and spatial perimeters of the fundamental rights entrenched in Section 38 of the Constitution( hereinafter referred to as “the Constitution”). The ‘extent’ element of the topic is addressed first. I have also addressed the ‘veracity’ of application of the right. The latter is with a view to ascertaining whether indeed that right truly enjoys recognition in our legal jurisprudence; and lastly if it does, how is it applied in real life by relevant state actors?
