LAGOS — Magistrate Sule Hamzat of an Ikeja Magistrate Court, Lagos, has struck out the rape charge against a 22-year-old undergraduate of Caleb University, Lagos, Ugochukwu Agudosi.
Agudosi, was arraigned on September 16, 2013 before the court for allegedly raping a 22-year- old lady.
At the resumed hearing in the matter, tdefence counsel said: “We have complied with the order for an affidavit of undertaking that the defendant will be of good behaviour. We apply that the case be struck out.”
Magistrate Hamzat in her ruling, said: “In view of the peculiarity of this matter, the court is of the view that there is a need to bind the defendant over to be of good behaviour. The defendant was once arraigned before court 6, Ikeja, on similar charge which was eventually struck out only to be arraigned on a similar offence on September 16.
“The complainant in this matter having written a letter of withdrawal forgiving the defendant, but to strike out the charge against the defendant, the defendant is hereby bound over to be of good behaviour for a period of one year failing which he shall be taken to prison custody for a period not less than 150 days. The charge against the defendant is hereby, struck out.”
