IBADAN — A Federal High Court judge in Ibadan has declined jurisdiction on contempt charges filed by the erstwhile Chairman of the National Union of Road Transport Workers, NURTW, Oyo State chapter, Alhaji Lateef Akinsola and 14 others against the Governor of Oyo State, the Commissioner of Police and 14 others.

The former NURTW in the state had filed a case marked FHC/IB/CS/30/2012, praying the court to grant  committal proceeding against the Oyo State governor and others.

According to  Tokyo, the respondents should be held responsible for alleged disobedience of an order contained in the judgement of the honourable court, delivered on May 25, 2012.

While delivering the judgment yesterday, Justice Abimbola Obaseki, held that it would amount to judicial rascality for his court to assume jurisdiction over the case.

The court said a copy of the notice of appeal against the May 25 judgment delivered by Justice Jonathan Sarkaho had been filed.

He said even though  the applicants reserved the rights to seek enforcement of their rights especially once a competent court of law confirmed such, once the defendants had appealed against the judgment and a notice of such an appeal served on the lower court, the trial judge must stay action pending the pronouncement of court of appeal.
