Nzeribe’s petition against Uba gets the boot

The Anambra Election Petition Tribunal (Panel 1) sitting in Akwa, the state capital, Wednesday, upheld the election of Dr. Andy Uba of Peoples Democratic Party, PDP, as the Senator representing Anambra South Senatorial District.

The Justice Onajite Kuejubola-led panel dismissed the petition of Chief Chuma Nzeribe, who was the All Progressives Grand Alliance, APGA, candidate in the said election held on April 9, 2011 for lack of merit and upheld Uba’s return.

Nzeribe and APGA had challenged Uba’s election, contending that he was not validly elected, as according to them, he was not qualified to contest the election because of the multiple candidacies of his party, PDP, in the said election.

The tribunal in its judgment, held that ground (a) of the petition failed because the Court of Appeal had earlier struck it out as it was a pre-election matter.

It also held that the petitioners were not able to prove beyond reasonable doubt, allegations of irregularities.
