LAGOS— ACE comedian, Alhaji Babatunde Omidina, (Baba Suwe), has asked a Federal High Court sitting in Lagos, to set aside the order it granted Nigerian Drug Law Enforcement Agency, NDLEA, weekend, to hold on to him for the next 15 days.

Baba Suwe is contending that NDLEA concealed material facts relating to his health and circumstances of his arrest and detention from the court while procuring the order.

According to him, the order obtained by the anti-drug agency was grossly irregular and constitutes an incurable abuse of court processes, adding that the application for the order obtained by NDLEA was contrary to public policy and constitutes wanton violation of his (Baba Suwe’s) fundamental rights.

It will be recalled that trial judge in the matter, Justice Okechukwu Okeke, had following an exparte application by NDLEA, granted it powers to keep Baba Suwe in custody for 15 more days.

NDLEA had deposed to an affidavit in support of the motion, which was also accompanied by a CT scan result issued by a consultant radiologist with Lagos State University Teaching Hospital (LASUTH), Dr. Subhash Vijayvargiya.

According to the affidavit, the CT scan result confirmed Baba Suwe has large amount of narcotic drug in his body.

Baba Suwe was arrested on October 12 while trying to board an Air France plane to Paris on suspicion that the scanning machine at the Murtala Mohammed International Airport, Ikeja, indicated that he had ingested substances suspected to be a hard drug.

NDLEA had insisted that Baba Suwe still has hard drug in his stomach, which he is bound to excrete it with time, adding that his case was not an isolated one as it takes some suspects a longer time to excrete than others, hence the need to further keep him in custody and  that it will take the comedian five to seven  days to complete excreting the whole drug in his stomach.
