Awka — Governor Willie Obiano of Anambra State and three others have been dragged to court by one of the contenders, who is claiming the traditional stool of Awka Etiti community in Idemili South Local Government Area, Igwe Chuma Ojukwu, for allegedly issuing certificate of recognition to the second contenderh, Michael Ezeudenna.
Others joined in the suit No. HID/ 297/2016 are the Attorney General and Commissioner for Justice of Anambra State; Commissioner for Local Government and Chieftaincy Matters and Mr Michael Chidozie Ezeudenna.
Currently, there are two monarchs claiming the traditional stool of the community. While the first was coronated on November 5, 2016, the other was allegedly issued certificate of recognition.
The plaintiff in the suit filed at a high court in Idemili by his lawyer, Mr Austin Arua, is praying the court to declare that: “He is the proper person to be issued the certificate of recognition by the first defendant as the Obi of Awka Etiti community.
“ An order of court directing the first defendant to withdraw the certifficate of recognition issued to the fourth defendant on November 3, 2016 as the Obi of Awka Etiti community.
“An order of court directing the first defendant to issue certificate of recognition to the plaintiff as Obi of Awka Etiti community.
“A declaration that the constitution of the people of Awka Etiti 2004 is null and void for lack of endorsement by the appropriate authority.”
The plaintiff avers that the traditional stool had been hereditary in his village, Nkolofia, while the other six villages produce the President General and Regent.
He said there was a peace accord in the community in 1995 which was enshrined in the 1999 bye law of Awka Etiti/Obi-in-Council and which was duly signed and implemented by the late Igwe Eze O. C. Ezenwa stipulating that the Igweship stool shall be hereditary in the Nkolofia village.
The suit further stated that the purported 2004 constitution of the community being paraded by some members of the community and the President General was tailored towards causing problem in the community.
