ABUJA—Justice Peter Affen of an Abuja High Court at Jabi, yesterday, struck out the suit that was filed against the factional chairman of the Nigeria Governors Forum, NGF, Mr Jonah Jang, by Governor Babatunde Fashola of Lagos State.
The action of the court followed decision of the plaintiff to withdraw the suit which he filed on June 5.
It will be recalled that Fashola had on July 17, filed a withdrawal application through his lawyer, Mr Femi Falana, SAN.
He had in the suit, urged the court to stop the Plateau State Governor, Jang, from parading himself as the factional chairman of the NGF.
Aside Jang, others who were listed as 1st to 4th defendants in the suit were the Director General of the NGF, Asishana Bayo Okauru, the factional Sole Administrator of the body under Jang, Mr Osaro Onaiwu and the Board of Trustees of the NGF.
He specifically prayed the court for order of injunction restraining Jang from using the name “Nigeria Governor’s Forum” in respect of any other organization that does not have the 36 governors as members and/or in any other manner inconsistent with the Constitution of the Governor’s Forum.
He equally urged the court to restrain one Mr Osaro Onaiwu (3rd defendants) from parading himself as the Sole Administrator of the Nigeria Governor’s Forum in any manner whatsoever and howsoever.
In a 19- paragraphed affidavit that was personally deposed to by Fashola himself, he told the high court that all the governors had met on May 25, 2013, and participated in a voting process that saw the re-election of Governor Amaechi as the chairman of the NGF.
