BENIN—GOVERNOR Adams Oshiomhole of Edo State and the state chapter of Action Congress of Nigeria, ACN, have filed their preliminary objections to the petition by the governorship candidate of Peoples Democratic Party, PDP, in the just concluded governorship election in the state, Gen. Charles Airhiavbere (rtd), before the election tribunal.
Airhiavbere is challenging the declaration of Governor Oshiomhole as the winner of the July 14, governorship election in the state by Independent National Electoral Commission, INEC.
Oshiomhole and ACN, in their objection and reply to the petition by Airhiavbere, argued that the Electoral Act (as amended) did not prescribe the qualification to be met “by a candidate seeking to contest election to the office of the governor of state,” and urged the court to disregard Airhiavbere’s claim that Oshiomhole did not have the educational qualification to contest as governor of the state.
Airhiavbere had argued in his petition that despite the non-update of voters register and the agreement that the voters register used for the 2011 general elections be used, amended voters register was used for the election, which according to his petition contributed to his defeat at the poll.
