Enugu high court judge grants bail to murder accused

Enugu – Justice Chiene Nwobodo of Enugu High Court on Wednesday granted bail to one Ndubuisi Usulor  accused of murder on the ground that no evidence of the allegation had been found.

Nwobodo, who granted the bail in the sum of N200,000, said the accused must produce one surety in like sum.

She said the accused should be released on bail, having been incarcerated since 2007, saying that she had not seen any incriminating evidence in the charge sheet.

The judge also said that the suspect had not made appearance in the court even though the case had been called up eight times.

She upbraided the prosecutors for failing in their duty and warned them to bring the accused at the next adjourned date on July 2.

Mr O. Akpamgbo, counsel for the accused, filed the motion praying the order of the court to grant bail to accused.

On her part, Mrs C.N. Edemba, the counsel for the state, said she did not object to the motion even though there was a charge in another court where the accused appeared to be implicated.

The suspect was alleged to have on Feb. 21, 2007, at Ozoma Lane, GRA Enugu, conspired with others at large to murder one Henry Aneke.

The court also adjourned another case of armed robbery preferred against Chukwuka Owoh till July 2 for further mention.

Mr C.J. Chime, for the state, told the court that the case file had been reviewed by the ministry of justice and recommended that the accused be charged with offence of unlawful societies.

Chime said the new charge will be filled on Tuesday next week.

Mr Okey Anike, the defence counsel, asked the court for a short adjournment for the new charge to be filed.

The accused was alleged to have on May 14, 2009, in the company of others and armed with dangerous weapons, robbed one Ogbonna Isreal of items valued at N55,000.

The accused was also alleged to belong to a secret society known as Junior Vikings Confraternity. (NAN)
