Prof. Dora Akunyili of All Progressives Grand Alliance, APGA, has said the National Assembly Election tribunal sitting in Awka, Anambra State, only struck out her petition against the declaration of Dr Chris Ngige of Action Congress of Nigeria, ACN, as winner of Anambra Central Senatorial election by Independent National Electoral Commission, INEC and not dismissed as reported in the media.
Reacting to the ruling, Akunyili said: “My case was not dismissed, it was struck out. Hearing of the case has not even started. We are still at the pre-hearing stage.
The striking out was because form 008 could not be found, it mysteriously disappeared. Unfortunately, the same form was raised earlier in a motion and the tribunal awarded to us that my lawyer duly filed the form.
“On October 4, the tribunal ruled in our favour on the form 008. Surprisingly, on October 19, the same tribunal ruled against us. What we are going to do now, is to appeal and I am very confident that the God of justice would give us justice.”
It will be recalled that Akunyili had gone to court along with her party (APGA), challenging the victory of Ngige in the April 2011 elections.
