The Court of Appeal sitting in Enugu, weekend, dismissed the petition by Prince Nicholas Ukachukwu challenging the election of Senator Andy Uba for Anambra South senatorial zone.

The court presided over by Justice Abubakar Jega, held that the petition brought by Ukachukwu was a pre-election matter, which raised intra-party dispute.

Consequently, the appellate court struck out the petition and upheld the ruling of the election tribunal sitting in Akwa.

Ukachukwu had gone to court to challenge the April election of Uba and his subsequent declaration by the Independent National Electoral Commission, INEC. He had contended that  he was the duly sponsored candidate of the Peoples Democratic Party, PDP,  and not Uba who was declared winner.

The cost of N30,000 was awarded against respondents in the case.

With this ruling, the legal battle over the authentic candidate of the PDP for Anambra South senatorial district has been laid to rest.
