Sokoto—The Court of Appeal sitting in Sokoto has ordered the Election Petition Tribunal in Birnin Kebbi, Kebbi State to retry the election petition filed by the former FCT Minister and CPC Senatorial Candidate for the Kebbi Central Senatorial District, Senator Muhammadu Aliero against Senator Abubakar Atiku Bagudu of the PDP.

The Appeal Court which quashed the judgment of the election Tribunal earlier delivered in favour of Senator Aliero, also advised the President of the Court of Appeal to reconstitute the National and State Assemblies Tribunal in Kebbi State to try Aliero’s petition.

The National and State Assembly Election Petition Tribunal sitting in Birnin-Kebbi had earlier invoked section 18 (11) of the 2010 Electoral Act and nullified the election of Senator Bagudu of the PDP and declared Senator Aliero winner of the election.

Delivering judgment in the matter, Justice Abubakar Datti Yahaya set aside the rulings of the court delivered on June 15 and August 16th 2011.

According to Justice Yahaya, the Tribunal erred in its judgments against the appellants, describing them as nullity.

Reacting to the judgment, Counsel to Senator Bagudu, Mr. Yakubu Maikyau, SAN expressed satisfaction with the outcome of the appeal, saying that they were ready to face the petition over again.
