PDP petitions Judicial Council over Fayemi’s victory

ABUJA—More than one week after Dr. Kayode Fayemi assumed office as Governor of Ekiti State following the judgment of the Court of Appeal in Ilorin, Kwara State, which declared him winner of the rerun election, People Democratic Party, PDP, has petitioned the National Judicial Council, NJC asking it to undertake a review of all judgments relating to the elections in Ekiti State since 2007, particularly, the last one that declared Fayemi winner.

Chairman, Ekiti State chapter of PDP, Chief Bola Oluojo, who made the call while speaking with newsmen at the party’s National Secretariat Abuja, shortly after briefing its national leadership, also called for a detailed investigation of the circumstances surrounding the alleged leakage of the Court of Appeal judgment to the Action Congress of Nigeria, ACN, before it was delivered as evidenced by statements by the national publicity secretary of the ACN.

The investigation, according to him, should encompass the two judgments of the lower tribunal that gave victory to the PDP candidate Engr. Segun Oni and the two at the court of appeal, one of which called for a rerun and the final one which voided the entire elections by cancelling the votes of Ido Osi , the home base of Oni.

He said the investigation was necessary to unravel the contradictory pronouncements against established precedence on electoral matters.

The party said while the Court of Appeal voided the elections in 2009 because INEC officials used wrong pen to mark the voters’ register, the election of Oni during the rerun was again cancelled on the excuse that the voters’ register used at the elections which was burnt by AC hoodlums was not produced.

“This was in spite of availability of Form EC8A, EC8B which had the real votes cast at the elections at the polling booths and ward levels.”

The party said  it was worrisome that the contents of the judgment was already posted on the internet before  the final delivery, adding that the AC national publicity secretary Lai Mohammed  weeks before the judgment had alluded to a favourable outcome such that members of the ACN had invested in  celebration and printing of inauguration programme days before the judgment.

“That explains the hurry to be sworn in by Fayemi without first collecting the certificate of return from INEC which was the right procedure.”

The obvious manipulations of the political system through the judiciary should now be worrisome to all lovers of democracy and should no longer be waived aside,” the party said.

It added  that while it was convenient and hypocritical for the media and human rights activists to laud any judgment that favours the opposition parties, the judgments should be subjected to detailed analysis to unravel allegations of corruption and manipulation of the judiciary.

He continued:  “It was patent injustice to use invidious means to cancel the elections of Ido osi, the home base of Engr Segun Oni, to deprive him of his own vote at the election just to benefit Dr Fayemi who scored 97% in his own base.

This situation has opened a new way of winning elections in the future, whereby opponents would invest heavily in violence and destruction of votes in the other candidate’s territory   in order to void the votes of the candidate to achieve his own victory Those who have devised ways of cheating their ways through the courts should beware that judgment of God is near and inescapable.”
