Court voids Akunyili’s cancellation of Mobitel’s 2.3GHZ slot

…orders NCC to restore licence

ABUJA—A Federal high court sitting in Abuja yesterday voided the cancellation by the immediate past Minister of Information and Communications, Prof Dora Akunyili, of the licensing process of national frequencies in the 2.3GHZ band.

The minister had nullified the licensing process on 25 May 2009 through a directive contained in a letter, citing lack of transparency as reason.

The trial high court judge, Justice Umar Garba who reversed Prof Akunyili’s cancellation of the licensing process said her action was reckless.

Specifically, the court, yesterday, issued an order of certiorari quashing the directive, cancelling the licensing process on the ground that Prof Akunyili’s decision was in excess of her powers and that her action was therefore null and void.

Justice Garba also issued a mandatory order compelling the National Communication Commission, NCC, to release forthwith the frequency slot in the 2.3GHZ spectrum already sold to Mobitel without any further delay, having satisfied all the requirements for the allocation.

Besides, the court issued a separate order of prohibition restraining the Ministry of Information and Communications from interfering in any manner capable of upsetting the licensing process of national frequencies in the 2.3GHZ band conducted by the NCC.
