Court fixes Nov 9 for ruling on jurisdiction of suit

Awka—Justice Peter Olayiwola of the Federal High Court in Awka, Anambra State, yesterday adjourned to November 9, further hearing in the suit by Mr Ken Emeakayi,  challenging Professor Chukwuma Soludo’s candidature as the PDP flag bearer for the 2010 Anambra governorship election.

Olayiwola adjourned for ruling, on whether the court has the jurisdiction to entertain the suit.

When the matter came up, the defense counsel representing PDP, Mr Patrick Ikwueto (SAN) and plaintiff counsel, Chief Emmanuel Egbunonu adopted their written addresses.

However, counsel to INEC,  Mr Suleiman Ibrahim, did not file a written address, but filed a memorandum of appearance.

While adopting his written address, Ikwueto, argued that two separate addresses were filed by counsel to Emeakayi, Mr Obi Obianwu (SAN) and Egbunonu.

Ikwueto, urged the court to strike out Obianwu’s address on the ground that he was yet to put up appearance in the matter.

Olayiwola in a short ruling struck-out the written address filed by Obianwu, saying  that the two written addresses could lead to confusion.

It will be recalled that preliminary objections were filed on October 19, by Ikwueto and Mr Olusola Oke, the defense counsel and National Legal Adviser to PDP, challenging the competence of the suit and the jurisdiction of the court to hear the suit.Soludo:
