2007 election: Supreme Court aborts Ohakim’s move to stall Agbaso’s suit

By Ise-Oluwa Ige

ABUJA—The Supreme Court,  yesterday ordered the Abuja division of the Court of Appeal to accelerate hearing in a suit by the gubernatorial candidate of the All Progressive Grand Alliance Party (APGA), Mr Martin Agbaso, seeking to remove Governor Ikedi Ohiakim from office.

That was after the apex court struck out two appeals filed by the incumbent Governor of Imo State, Ikedi Ohiakim and the INEC to frustrate the trial of the case at the court below.

The said two separate appeals were challenging the decision of the Court of Appeal, Abuja to assume jurisdiction on the subject-matter of Agbaso’s suit as constituted.

A five-member panel of the Supreme Court led by Justice Dahiru Musdapher terminated the appeals yesterday, following an oral application to withdrawal them.

The apex court practically made them withdraw the appeals on the ground that it was a ploy to delay quick dispensation of justice in the case.
