Reps hail Appeal Court on Nzeribe

ABUJA—Members of the House of Representatives yesterday, commended a recent decision of the Appeal Court sitting in Enugu, quashing the election of Mr Chuma Nzeribe, representing PDP/ Ihiala/Anambra state.

The Appeal Court, had last week nullified the election of Mr. Nzeribe and ordered the Independent National Electoral Commission (INEC) to withdraw his certificate of return and issue Mr. Vitalis Okafor, the appellant, a certificate of return.

Okafor had filed a petition at the elections tribunal, seeking to vacate the decision of the Peoples Democratic Party (PDP) to field Nzeribe in the House of Representatives race in the April 21, 2007 elections, despite Nzeribe coming second at the said party primaries.

His petition was however, dismissed by the lower tribunal, and not satisfied with the decision, we appealed against same at the Court of Appeal.

In its lead judgement by Justice Alfred Ariwoola, the Appeal Court held that the lower court erred in its judgement and upheld Okafor as the substantive candidate of the party in the election.
