A LEGAL practitioner based at Kwale, Delta State, Mr. Nelson Enumah has filed a contempt charge at Kwale High Court seeking the court to commit the State Commissioner of Police, Mr. Jacob Oshiomogho, DPO Enerhen and two other police officers to prison for allegedly failing to comply with an earlier order made by the court
The Court order directed them (Police) to produce the applicant’s Mercedes Benz car they impounded. Kwale High Court presided over by Justice G. B. Briki-Okolosi had on the 10th day of July 2008, while ruling in an ex-parte motion brought by the lawyer ordered, “That the respondents (Police) produce the said Mercedes Benz car together with the key and original papers in this court at the hearing of the application on notice.”
In an 11-paragragh affidavit in support of his application for committal Form 48 (Notice of Consequence of Disobedience or Order of Court), Mr. Enumah stated that, “Unless the parties sought to be committed are committed to prison, they will not desist from flouting the orders of this honourable court or indeed any other court of law, moreso when the parties being police officers have a very high onus/constitutional/legal duties to obey orders of court.”
Lawyer Enumah who stormed Vanguard’s office weekend said, “The order has not been complied with despite the fact that they were served with the Notice of Disobedience since 25th of July 2008, they have refused to comply.”
He further maintained that, “Considering the fact that the respondents are law enforcement agents it will be insult on administration of justice and Rule of Law to allow the respondents to violate court order in a cavalier and disdainful manner.”
