Resumed hearing into the civil aspect of Pfizer case at the Kano High Court on Monday was stalled following protest by the team of defense counsel that questioned the impartiality of the new Judge, Justice Patricia Mahmud in the case.
The new dimension introduced by the Pfizer team however compelled the interested parties to retire to the court chambers to iron out the concern raised by the defense lawyers. Pfizer lawyers claimed that the new Judge, Justice Patricia Mahmud is a wife to A B Mahmud, Counsel to Professor Idris, Chairman, Federal Government Panel that indicted Pfizer in 1996 Trovan test in Nigeria. After nearly three hours of brainstorming at the chambers, Justice Patricia Mahmud, requested both parties to write a fresh suit seeking to discuss the issue on the floor of the court in the presence of everybody not in the chambers as demanded by the Pfizer, and then adjourned the case for hearing of the allegations to 27 of October 2008. In a separate chat with newsmen shortly after the meeting, counsel to the victims, Mr. Babatunde Irukeru lamented that no positive resolution seem to be in sight, despite their significant assistance to the legal process. Irukeru however added that the slow legal process does not mean they are not making progress, a s he expressed optimism that something meaningful would come out of it by the end of the day. The counsel to the Pfizer, Chief Anthony Idigbe [ SAN] denied rumors that talks between Pfizer and the Government/victims have broken down, adding that they are still on it and there was light at the end of the tunnel. Vanguard reports that thousand of victims family that turned up for the case on Monday went home disappointed as a cross section complained bitterly about the ‘sluggish’ legal procedure. |
