Akure—A timber contractor, Ojo Owoeye, has asked an Ikare Akoko Customary Court in Ondo State to dissolve his 16 years old marriage with his wife, Bola, for allegedly sleeping with his junior brother.
Ojo said this in his defence in a case of marriage dissolution brought against him by his wife.
The wife had approached the court, asking it to dissolve her marriage to Ojo on the grounds of lack of care for her and their three children, desertion for the past four years and lack of love.
However, in his defence, Ojo did not disagree with all the allegations but accused the wife of infidelity. He said he decided to desert and abandon her because of her behaviour, which irritated him.
After listening to both parties, the court came to the conclusion that the union between the two was not appropriate and that all that transpired between them in the last 16 years was not marriage because it was not in conformity with Ondo State Customary Law, 2006.
The Court President, Chief M. Awe, declared that there was no marriage to dissolve and held that the two were free to go their separate ways and remarry.
He granted the custody of the first and last born to the mother, while the second child was ordered to be with the father.
