N7m scam: Court sets aside bench warrant for arrest of accused

An FCT High Court on Thursday set aside a bench warrant for the arrest of an Abuja-based businessman, Chuzi Ozir, due to the accused deteriorating health condition.

Justice Olusumbo Goodluck set aside the order after listening to the submissions of the accused counsel, Mr Mohammed Tola, over the health condition of the accused.

Goodluck also ordered that the accused should continue with the bail conditions earlier granted by the court.

She adjourned the case until Sept. 25, for continuation of trial.

The accused counsel had earlier filed a motion dated Feb. 20, seeking for an order of the court to set aside the bench warrant for the arrest of his client, for absconding from trial.

Tola also prayed the court to allow the second accused (Ozir) to continue with his bail pending the determination of the

substantive suit.

He presented a medical report from Lagos University Teaching Hospital on behalf of the accused.

“In the light of foregoing, the patient has been restricted from any form of work for the next three months.

“He is not physically fit to do so,” the report said.

However, the EFCC counsel did not oppose the application.

Ozir is standing trial alongside his partner, Ngwuike Chukwudi, on two counts of conspiracy and fraud which they pleaded to be innocent. (NAN).
