IPMP drags PMPI to court over alleged infringement of trade name
By SIMON EBEGBULEM
BENIN CITY- International Project Management Professionals, IPMP, has dragged the management of Project Management Professional Institute, PMPI, before a Federal High Court sitting in Benin, Edo State, over alleged infringement of trade name.
In the writ of summons and statement of claim, signed by Counsel to IPMP, Barr. Eniye Ewean, the plaintiff is asking the court to stop the defendants from carrying out project management training in the name and style of Project Management Professional Institute and also to pay the sum of N10 million as damages.
They alleged that the Defendants have been using the unincorporated name of Project Management Professional Institute (PMPI) which is a similar name to the plaintiff’s own to mislead the National Youth Service Corps (NYSC) and the general public into believing that they were carrying out project management training in the name of Project Management Institute (PMI) and that they are one and the same entity as Education Provider.
But defendants in their counter claims before the court, denied impersonating the plaintiff or infringing her trade name, adding that they have not incorporated the name Project Management Professional Institute (PMPI) and do not intend to do so, that they only in June 2011 registered the business name of Barde PMPI Consulting under part B of the Company and Allied Matters Act as an enterprise to enable them do project management training.
Presiding Judge, Justice A.M.Liman fixed January 31, 2013 as date for hearing of the motion for interlocutory injunction.
