LAGOS—The Court of Appeal, Lagos, has upheld the election of Action Congress of Nigeria, ACN, candidate for Lagos West Constituency, Mr. Ganiyu Solomon, after dismissing the appeal by People’s Democratic Party, PDP, senatorial candidate in same election, Mr. Moshood Adegoke Salvador.
The court agreed with the decision of the lower tribunal, that the petition by Salvador was fundamentally defective as it did not contain any prayer for the nullification of Solomon’s election.
The appellate court also ordered Salvador to pay N50,000 as cost to each of the respondent.
The lower tribunal sitting in Lagos had in October dismissed Salvador’s petition against Solomon.
Salvador appealed against same, urging the Court of Appeal to set aside the judgment of the tribunal and order a fresh panel set up by President of the Court of Appeal to hear his petition de novo (afresh).
But the Court of Appeal dismissed his appeal.
