Yar’Adua: NCP prays court to declare Appropriation Act illegal

The National Conscience Party (NCP) has dragged the Attorney General of the Federation (AGF) before a Federal High Court sitting in Abuja asking the court to determine whether the ailing President UmarYar’ Adua is competent to assent to a supplementary bill passed by the National Assembly on his sick bed.

The party also in its originating summons prays the court to determine whether the president who was on medical vacation for more than 42 days as prescribed by the ought not be examined by a team of medical Board.

The suit filed on behalf of the party by the Falana and Falana chambers, Lagos therefore seek a declaration by the court to state that the supplementary appropriation Act 2009 purportedly signed by the President outside the country “was illegal, unconstitutional, null and void as it was purportedly signed by the President on or before December 29,2009,while on medical vacation in Saudi Arabia.”
